Session 2019-20HB 1101 dramatically increases the amount of information insurers must gather to attempt to settle a claim, requires that the information be gathered and submitted in excessively specific ways, mandates that insurers essentially advertise for plaintiff’s attorneys in written communications, and reduces the time insurers have to do this work from 60 days to a near-impossible requirement of 30 days. These sweeping changes apply to all insurers and all types of insurance. Every Georgia citizen relies on a competitive insurance marketplace to protect them and keep rates low and accessible to all. HB 1101 would have created uneasiness in this market and fundamentally changed the way that Georgian’s insurers process claims, leaving their customers to slog through the new requirements with their insurer at an unrealistic pace.
Although passed out of the House Special Committee on Access to Civil Justice, HB 1101 did receive a vote in the House of Representatives.
